Serviceable Address for Individuals: When Do You Need One?

As a private individual in Germany, you mainly need a serviceable address in three situations: running a website or channel that isn't purely personal, filing a lawsuit yourself, and dealing with public authorities. Normally that's just your home address. For an Impressum, though, you can use a rented address instead, as long as mail is reliably accepted there.

Most guides to serviceable addresses are written for businesses. Yet the topic touches plenty of people who'd never call themselves entrepreneurs: hobby bloggers running a few affiliate links, podcasters, club board members, people living abroad for a stretch.

What is a serviceable address?

An address where formal documents, including a letter from a court, can actually be delivered to you. That requires a street address where you live or where someone accepts mail on your behalf. A PO box or a parcel locker doesn't qualify.

Situation 1: your website isn't purely personal anymore

This is where most private individuals get tripped up. Two rules matter here.

Section 5 DDG requires a full Impressum for digital services run on a commercial basis. A blog can already count as commercial if it earns money through ad banners or affiliate links, no matter how little.

Section 18 of the Interstate Media Treaty (Medienstaatsvertrag) goes further. Even a website with zero revenue has to list a name and address unless it serves exclusively personal or family purposes. A public gardening blog is more likely to fall under this than a private family photo album.

The line isn't always sharp. As a rule of thumb: once you're addressing content to the public, earning money from it, or planning to eventually, you should have an Impressum.

Do I have to publish my home address, then?

No. You can list a rented address instead, as long as it's serviceable, meaning mail is actually accepted there for you. That's exactly what Impressum services are for.

An example: from hobby to Impressum

Picture a teacher in Freiburg who writes a hiking blog about the Black Forest in her spare time. At first, only friends read it. Two years later, the blog has several thousand readers a month, and she links her favorite hiking boots through an affiliate program.

That makes the blog commercial, and she needs a full Impressum. She doesn't want her home address there, for good reason: she lives in a small town and regularly posts photos from her own front door into the forest. She rents an Impressum address, lists it, and gets mail from readers or partners as a scan in the app.

Nothing changes for her tax or residence registration. She still lives where she's registered. The rented address is just the public face of her blog.

Situation 2: you file a lawsuit yourself

Anyone filing a claim has to state their address in the complaint. Under German Federal Court of Justice case law, that's generally the home address, so the court and the other side know who's suing and where service can reach them.

Exceptions exist if you have a protectable interest in keeping your home address secret, for example because you're facing threats. You'd have to justify that to the court. A rented business address doesn't automatically replace your home address here. Get legal advice if this applies to you.

Situation 3: you have no fixed address

People traveling long-term, digital nomads, or anyone splitting time across countries face a specific problem: where should the bank, insurer, tax office, and health insurer send mail?

Two things need separating here:

  • Registration address: A rented business address isn't a residence. If you live in Germany, you have to register wherever you actually live. Moving abroad means deregistering.
  • Postal address: For ongoing mail and as a contact address, you can use an address with a digital mailbox instead. Your letters get scanned, and you read them wherever you happen to be.

When it's about your safety: the information block

Separate from the Impressum question, anyone in Germany can look up your home address through a simple residents' registration inquiry. If that creates a danger to your life, health, or liberty, for instance through stalking, you can apply for an information block (Auskunftssperre) at the registration office under Section 51 of the Federal Registration Act (Bundesmeldegesetz). You have to state your reasons.

That's not a substitute for an Impressum address, but an important addition if you're in the public eye.

Do I need an Impressum as a private individual? Only if your site doesn't serve exclusively personal or family purposes, or you earn money from it. A public blog with ads or affiliate links usually needs one.

Can I list a rented address in my Impressum as a private individual? Yes, as long as mail is accepted there for you and formal service is possible. A PO box isn't enough.

Can I register a rented address as my residence? No. Residents' registration requires the place where you actually live. A business address isn't a home.
