If you run an Instagram account for business or professional purposes and it targets a German-speaking audience, you need your own legal notice (Impressum), separate from the one on your website. The bar for "commercial" use is low: a link to your own website, promoting products, or a single paid collaboration is enough to trigger the requirement.
The legal basis is the same as for websites, Section 5 of the Digital Services Act (DDG, formerly Section 5 TMG), plus Section 18 of the German Interstate Media Treaty for editorial content. Purely private profiles without any commercial angle are exempt.
Do content creators need an Impressum?
Yes, as soon as your account is not exclusively private. This applies in particular to:
- Brand collaborations or paid posts
- Linking your own or third-party products and services
- Affiliate links in your bio or stories
- Self-promotion for a website, online shop, or coaching offer
Whether a single post needs to be labeled as advertising is a separate question under Section 5a of the German Unfair Competition Act, and it's independent of whether the account needs an Impressum at all.
Impressum in the Instagram bio: the two-click rule
Instagram has no dedicated Impressum field, so creators typically link through the bio. The relevant standard is the two-click rule: your Impressum must be reachable from your profile in no more than two clicks.
In practice: one click on your bio link, then one more click on a clearly labeled "Impressum" or "Legal notice" button. If you use a link-in-bio tool with several links, make sure one of them leads to the Impressum directly, or through at most one extra step. Instagram now allows up to five links in a profile, which gives you room to fit this in.
What information does the Instagram Impressum need?
The required content is the same as for a website Impressum:
- Full name or company name with legal form
- A serviceable address (ladungsfähige Anschrift)
- An email address
- For corporations: commercial register number, register court, authorized representatives
- VAT ID, if you have one

Private account or business profile: where's the line?
German courts draw this line narrowly. The Hamburg Higher Regional Court (OLG Hamburg) ruled on 21 May 2026 (case no. 15 U 99/24) that accounts with very large reach and a commercial angle need an Impressum too, and that a clearly visible bio link to a complete Impressum is sufficient. The case involved an influencer with 9.3 million followers promoting products from a company she was substantially involved in. If you regularly show products, share discount codes, or point to your own offer, assume the commercial-use threshold is met.
Consequences of a missing or incomplete Impressum
A missing or incomplete Impressum on Instagram can be subject to a cease-and-desist letter, just like on a website, often issued by competitor associations. Beyond the warning itself, you risk costs for the declaration to cease and desist, and contractual penalties if it happens again.
How to set up your Instagram Impressum correctly
- Keep your website Impressum complete and current, it's the basis for the link
- Add a link-in-bio tool or a direct website link to your Instagram bio
- Make sure it leads to the Impressum in at most one more click
- Check regularly that the link still works, a dead link counts as a missing Impressum
